I - SCOPE AND ACCEPTANCE

1.1. This terms and conditions document governs:

  • access to and use of the website;
  • The creation and use of customer accounts; and
  • The purchase of products from Dr. Martens Indonesia through the website.

1.2. Before placing an order, you must read and confirm your agreement to these Terms and Conditions. Merely accessing the Website without placing an order does not create a sale contract between you and Dr. Martens Indonesia.

1.3. The following documents, in the versions made available to you before you place an order, form part of the contract:

  • The product information on the relevant product page;
  • The order accepted by Dr. Martens Indonesia;
  • The Shipping Policy;
  • The Return and Refund Policy;
  • The terms of any applicable promotion; and
  • Any other specific terms confirmed by you before placing an order

1.4. In the event of inconsistency:

  • The specific terms confirmed for an order shall prevail in respect of that order; and
  • Where the Indonesian and English versions differ, the interpretation or version more favourable to the consumer shall apply to the extent required by applicable law.

II - ELIGIBILITY AND CAPACITY

2.1. You may place an order only if you have the legal capacity required to enter the transaction under Indonesian law.

2.2. If you are a minor (less than 18 years of age) or have restricted legal capacity, you may use the Website and place an order only under the supervision and with the consent of your parent, guardian or legal representative where such consent is required by law.

2.3. A representative who permits a minor to use the Website is responsible for supervising such use to the extent permitted by law.

III - CUSTOMER ACCOUNTS

3.1. You must provide accurate, complete and up-to-date information when creating an account or placing an order.

3.2. You are responsible for taking reasonable measures to protect your login credentials, password and devices. You must promptly notify Dr. Martens Indonesia if you suspect that your account has been accessed or used without authorisation.

3.3. You will not be responsible for transactions occurring after Dr. Martens Indonesia has received valid notice that your account has been compromised, except where the loss results from your fraud or wilful misconduct.

3.4. Dr. Martens Indonesia may temporarily suspend an account where there are reasonable grounds to suspect fraud, unauthorised access, unlawful conduct or a material breach of these Terms and Conditions. Where reasonably practicable and permitted by law, Dr. Martens Indonesia will notify you of the reason and the process for restoration or complaint.

IV - INTELLECTUAL PROPERTY AND WEBSITE USE

4.1. The Website and its contents, including trademarks, logos, images, graphics, text, videos, designs, interfaces, databases and software, are owned by or lawfully licensed to Dr. Martens Indonesia or the relevant licensors.

4.2. Dr. Martens Indonesia grants you a limited, non-exclusive, non-transferable and revocable right to access and use the Website for personal, non-commercial and lawful purposes.

4.3. Unless authorised in writing by Dr. Martens Indonesia or the relevant rights holder, you must not:

  • Copy, republish, distribute, sell or commercially exploit Website content;
  • Use robots, crawlers, scrapers or automated tools for unauthorized data collection;
  • Circumvent or interfere with security measures;
  • Upload malicious code, viruses or harmful materials;
  • Overload, interrupt or impair the operation of the Website;
  • Use the Website for fraud, impersonation, infringement of third-party rights or unlawful conduct; or
  • Use Dr. Martens Indonesia trademarks as hidden keywords, meta tags or in a manner that falsely suggests an association with Dr. Martens Indonesia.

V - PRODUCT INFORMATION

5.1. Dr. Martens Indonesia will use reasonable efforts to ensure that product information is complete, accurate, current and consistent with information provided by the manufacturer, brand owner or lawful supplier.

5.2. Depending on the product, the disclosed information may include the product name, brand, product code, origin, manufacturer or importer, materials, colour, size, key characteristics, instructions, warnings, price, taxes, charges, warranty terms and return conditions.

5.3. Product images are provided for illustration. Displayed colours may vary slightly due to screen settings, lighting or photography. This does not limit your rights where the actual product materially differs from its description or the sample provided.

5.4. A sizing tolerance applies only where it:

  • Is consistent with the ordinary nature of the product;
  • Is clearly disclosed on the product page; and
  • Does not cause the product to be inconsistent with its description or ordinary purpose.

5.5. General sports, health or fitness information on the Website is for reference only and is not a substitute for medical or professional advice.

VI - PRICES, TAXES, CHARGES AND PROMOTIONS

6.1. Product prices are displayed in Indonesian Rupiah and include value-added tax unless the Website lawfully and clearly states otherwise.

6.2. Before you place an order, the Website will display:

  • The price of each product;
  • The quantity;
  • Any discount or promotion;
  • Delivery charges
  • Applicable taxes and other charges, if any; and
  • The total amount payable

6.3. Dr. Martens Indonesia may change prices or promotions for future orders. A change will not affect an order already accepted by Dr. Martens Indonesia unless you and Dr. Martens Indonesia otherwise agree or the change is required by law.

6.4. Promotions apply only during the stated period and within the disclosed scope, quantity and conditions. Each promotion may be subject to separate terms made available before you place an order.

VII - ORDERING PROCESS AND CONTRACT FORMATION

7.1. The Website will allow you to review and correct the key details of your order before clicking the “Place Order” button, including the products, size, colour, quantity, address, delivery method, payment method and total amount.

7.2. The display of products on the Website is an invitation for you to make an offer to purchase and is not an unconditional commitment by Dr. Martens Indonesia to sell the product.

7.3. By clicking the “Place Order” button, you submit an offer to purchase the products in your order on the price and terms displayed and confirmed at that time.

7.4. After receiving your order, Dr. Martens Indonesia may send an automated email or notification acknowledging receipt of the order (the “Order Confirmation”). Unless it is expressly identified as an “Order Shipment”, an Order Confirmation does not constitute acceptance of your offer.

7.5. The sale contract is formed when Dr. Martens Indonesia sends you a clear confirmation that your order has been shipped (the “Order Shipment”). The Order Shipment may be sent together with other dispatch-related information.

7.6. The contract is formed only for the products listed in the Order Acceptance. If part of an order is not accepted, Dr. Martens Indonesia will notify you and refund any corresponding amount collected.

7.7. The order details, applicable version of the terms and transaction confirmation will be made available by email or through your customer account and retained for the period required by law.

VIII - ORDERING REJECTION, ERRORS AND OUT-OF-STOCK ITEMS

8.1. Before issuing order delivery information, Dr. Martens Indonesia may reject all or part of an order for a reasonable cause, including where:

  • A product is out of stock or fails quality control;
  • The delivery information is incomplete or outside the supported area;
  • Payment is not authorized or is declined;
  • There are reasonable grounds to suspect fraud, impersonation, unauthorized resale or breach of quantity limits;
  • There is an obvious error in the price, description or product configuration; or
  • Dr. Martens Indonesia is prohibited by law or a competent authority from completing the transaction.

8.2. If a pricing error is identified before the order is accepted, Dr. Martens Indonesia will cancel your order and notify you.

8.3. Dr. Martens Indonesia will not unilaterally increase the price or cancel an order after the contract has been formed unless:

  • You agree;
  • Cancellation is necessary to address verified fraud;
  • Performance is impossible due to a force majeure event; or
  • Cancellation is permitted or required by law.

IX - PAYMENT

9.1. Supported payment methods will be displayed at checkout and may include:

  • Credit or debit cards;
  • ATM cards or bank accounts;
  • Mobile banking;
    1. QRIS;
    2. Buy Now Pay Later;
  • Electronic wallets; and
  • Other methods disclosed by Dr. Martens Indonesia.

9.2. Payment transactions may be processed by banks, card schemes, payment gateways or independent payment service providers. Payment processing may be subject to the additional terms of the relevant provider.

9.3. Dr. Martens Indonesia will not ask you to provide a CVV, banking password or one-time password by email, telephone, social media or an unsecured chat channel.

9.4. Dr. Martens Indonesia or the payment provider may carry out authentication, temporary fund holds or transaction authorisation. Funds will be charged or settled in accordance with the process displayed at checkout and the selected payment method.

9.5. Dr. Martens Indonesia may request reasonable verification where the customer, recipient and payment instrument holder have different names. An order will not be automatically cancelled solely because the names differ if the transaction can be lawfully verified.

X - DELIVERY, TITLE AND RISK

10.1. Dr. Martens Indonesia will deliver the products to the address confirmed in your order and within the disclosed delivery area.

10.2. You are prohibited from requesting a delivery address change after an order has been confirmed. Dr. Martens Indonesia will attempt to accommodate order cancellation for you to create a new order but cannot guarantee cancellation once the order has been packed, transferred to the carrier or delivered. If the order is successfully cancelled, you may create a new order with the correct delivery address.

10.3. Any stated delivery time is an estimate unless Dr. Martens Indonesia expressly confirms that it is a fixed delivery deadline.

10.4. The risk of loss of or damage to the products passes to you when you or a person designated by you, other than the carrier, takes possession of the products.

10.5. Title to the products passes to you when the products have been delivered, unless otherwise provided by law or the specific payment terms.

10.6. Dr. Martens Indonesia may not offer an open-box inspection service upon delivery. The absence of such inspection does not waive or limit your right to report products that are incorrect, missing, damaged, defective or otherwise non-conforming after delivery.

10.7. If delivery fails because the information you provided is incorrect or no recipient is available, Dr. Martens Indonesia will contact you to arrange redelivery or collection. Reasonable additional costs may be charged only if disclosed in advance and the failed delivery is attributable to you.

XI  WRONG PRODUCT AND RIGHTS TO SUBMIT A RETURN REQUEST

11.1. This Section applies to a product that:

  • Is the wrong product, size, colour or quantity;
  • Is missing a component or accessory;
  • Was damaged before risk passed to you;
  • Is defective;
  • Materially differs from its description, image, sample or disclosed information;
  • Fails to meet applicable quality, safety or ordinary-use requirements; or
  • Is otherwise subject to a statutory remedy.

11.2. Your rights under this Section apply to all products, including discounted, promotional, limited-release and clearance sale products.

11.3. Depending on the nature of the issue and applicable law, you may request one or more of the following remedies:

  • Supply of missing items;
  • Replacement with a conforming product;
  • Full return and refund; or
  • Compensation

11.4. Dr. Martens Indonesia will bear reasonable shipping costs relating to the collection, inspection, repair, replacement or return of a product covered by this Section, unless a reasonable inspection establishes that the issue was caused entirely by your misuse, intentional damage or failure to follow applicable instructions after delivery.

11.5. Missing or damaged packaging does not automatically remove your rights under this Section, although you must take reasonable care to preserve and package the product when returning it.

11.6. The 7-day period applicable to the voluntary change-of-mind policy in Section 12 does not limit any statutory complaint period or other right relating to defective, unsafe, incorrect or non-conforming products.

XII - VOLUNTARY CHANGE-OF-MIND-RETURNS

12.1. In addition to your statutory rights under Section 11, Dr. Martens Indonesia allows you to request a return of an eligible product within 7 calendar days after delivery if you change your mind.

12.2. A change-of-mind product return must:

  • Be unused, unwashed and not worn beyond reasonable fitting;
  • Be free from stains, odours, damage or deformation;
  • Retain its tags, labels and accompanying accessories;
  • Include the original packaging in reasonable condition where the packaging forms a material part of the product; and
  • Be accompanied by proof of purchase.

12.3. For health and hygiene reasons, the change-of-mind policy may not apply to the following products if the exclusion was clearly disclosed before the order was placed:

  • Underwear, swimwear or products in direct contact with intimate areas after the hygiene seal has been opened;
  • Socks or similar products after hygienic packaging has been opened;
  • Personalized or made-to-order products;
  • Products that cannot be resold for health or hygiene reasons after the seal has been opened;
  • Limited-release, launch or final-sale products clearly marked as such before purchase; and
  • Any other product that may lawfully be excluded and is specifically identified on the product page.

12.4. The exclusions in Section 12.3 apply only to change-of-mind returns and do not apply to products covered by Section 11.

12.5. For a change-of-mind return:

  • You arrange the shipment and bear the return shipping cost unless Dr. Martens Indonesia states otherwise;
  • The original delivery charge is non-refundable unless required by law or Dr. Martens Indonesia provides a more favourable policy; and
  • Where permitted by law, Dr. Martens Indonesia may deduct an actual reduction in value caused by handling beyond what is reasonably necessary to inspect the product.

XIII - EXCHANGE

13.1. Where Dr. Martens Indonesia supplies the wrong product, size or colour, or a defective product, you may request a replacement under Section 11, subject to stock availability and applicable statutory remedy rights.

13.2. For a change-of-mind request, Dr. Martens Indonesia does not currently provide a direct exchange for a different size, colour or style unless otherwise stated on the Website. You may return an eligible product for a refund and place a new order.

13.3. A replacement product is not guaranteed to retain the original promotional price or stock availability unless the replacement is a remedy for an issue attributable to Dr. Martens Indonesia and applicable law provides otherwise.

XIV - RETURN REQUEST AND REFUND PROCESS

14.1. You may submit a request through:

  • Email: connect@drmartens.id; or
  • Any other support channel disclosed on the website.

14.2. A request should include:

  • The order number;
  • Your name and contact details;
  • The product name or code;
  • The reason for the request; and
  • Reasonable photographs or videos where necessary to identify the issue.

14.3. Dr. Martens Indonesia will acknowledge receipt of a request or complaint within no more than three working days and provide instructions on the next steps.

14.4. For a change-of-mind return, you must arrange the return shipment, and the product must be sent to the designated address within 7 calendar days after Dr. Martens Indonesia approves the request, unless a different period is agreed.

14.5. You must package the product according to the way you had received it to minimise damage during transit. A “Fragile” label is not mandatory unless Dr. Martens Indonesia specifically instructs you to use one and it is appropriate for the product.

14.6. Dr. Martens Indonesia may inspect a returned product. Any inspection will be conducted objectively, within a reasonable period and without limiting the consumer’s statutory rights.

14.7. Once Dr. Martens Indonesia has received the return product, Dr. Martens Indonesia will determine the validity of the return product. If a product mismatch or product condition mismatch is found during the inspection process, Dr. Martens Indonesia may reject the return product and process the redelivery of the product to you.

14.8. Once Dr. Martens Indonesia has received and approved the returned product, Dr. Martens Indonesia will initiate the refund within 7 [seven] working days or any shorter period required by law. The refund will be made to your bank account.

14.9. The time for refunded funds to appear in your account may depend on the bank or payment provider. Dr. Martens Indonesia will provide evidence that the refund was initiated upon reasonable request.

XV - WARRANTY, SAFETY AND PRODUCT RECALLS

15.1. Where a product is covered by a warranty, the warranty conditions, period, scope and contact point will be disclosed on the product page, accompanying documents or Dr. Martens Indonesia’s support channels.

15.2. A manufacturer’s or brand owner’s warranty does not replace or reduce Dr. Martens Indonesia’s statutory responsibilities as the Seller.

15.3. If Dr. Martens Indonesia becomes aware that a product is defective or poses a safety risk, Dr. Martens Indonesia will take a few measures, which may include:

  • Suspending sales;
  • Notifying customers;
  • Recalling the product;
  • Repairing, replacing or refunding the product; and
  • Compensating for loss.

XVI - ORDER CANCELLATION

16.1. You may request cancellation before an order is processed for delivery. Dr. Martens Indonesia will attempt to accommodate the request but cannot guarantee cancellation once the order has been packed, transferred to the carrier or delivered.

16.2. If the order cannot be cancelled, you may still exercise any applicable return rights under Section 11 or Section 12.

16.3. Dr. Martens Indonesia may cancel an accepted order only in the circumstances stated in Section 8.3 or otherwise permitted by law. Dr. Martens Indonesia will notify you of the reason and refund all amounts collected for the cancelled portion.

XVII - PERSONAL DATA AND MARKETING COMMUNICATIONS

17.1. Dr. Martens Indonesia processes personal data in accordance with the Personal Data Protection Notice/Policy published on the Website and applicable law.

17.2. The data protection notice will explain, as applicable:

  • The categories of data processed;
  • The purposes and legal bases for processing;
  • The data controller and processors;
  • Recipients of the data;
  • Any cross-border transfer;
  • Retention periods;
  • Possible risks or consequences; and
  • Data subject rights and how to exercise them.

17.3. Data necessary to receive orders, process payments, deliver products, prevent fraud, comply with accounting and tax obligations, provide warranty or recall services and resolve complaints may be processed on an appropriate legal basis.

17.4. Advertising, direct marketing, non-essential cookies, behavioural tracking or personalised advertising will be based on a separate choice where required by law. Refusal or withdrawal of consent for non-essential purposes will not prevent you from placing an order.

17.5. You may exercise your personal data rights under applicable law, including the rights to be informed, consent, withdraw consent, access, correct, request deletion, restrict or object to processing and lodge complaints.

XVIII - ELECTRONIC COMMUNICATIONS

18.1. You agree that contracts, order confirmations, electronic invoices, delivery notices and other communications may be provided electronically.

18.2. An electronic communication is deemed received when it enters the information system designated by the recipient and is capable of being accessed at that electronic address, unless otherwise provided by law or a specific agreement.

XIX - WEBSITE AVAILABILITY AND THIRD-PARTY LINKS

19.1. Dr. Martens Indonesia uses reasonable efforts to keep the Website secure and available but does not guarantee uninterrupted or error-free operation, particularly during maintenance, upgrades or events outside its reasonable control.

19.2. Dr. Martens Indonesia will apply appropriate technical and organisational measures to protect the Website and data. Nothing in these Terms excludes Dr. Martens Indonesia’s liability for a breach of its statutory security or data protection obligations.

19.3. The Website may contain links to third-party websites or services. Dr. Martens Indonesia does not control third-party content but remains responsible for its own obligations and will not rely on the involvement of a third party to exclude liability imposed on Dr. Martens Indonesia by law.

XX - LAWFUL LIMITATION OF LIABILITY

20.1. Nothing in these Terms and Conditions excludes or limits:

  • Mandatory consumer rights;
  • Liability for death or personal injury caused by Dr. Martens Indonesia’s fault
  • Liability for fraud, wilful misconduct or gross fault;
  • Liability for defective, unsafe or recalled products;
  • Personal data protection liability
  • Statutory refund, warranty, repair or replacement obligations; or
  • Any other liability that cannot lawfully be excluded or limited.

20.2. Dr. Martens Indonesia is not liable for indirect losses or losses that were not reasonably foreseeable at the time of contracting, where such losses do not arise directly from Dr. Martens Indonesia’s breach.

20.3. Dr. Martens Indonesia is not responsible for loss caused entirely by:

  • Inaccurate information supplied by you;
  • Your misuse of the product or failure to follow instructions after delivery;
  • Unauthorized repair or alteration of the product; or
  • Your unlawful conduct, fraud or wilful misconduct,

Provided that Dr. Martens Indonesia establishes the relevant causal connection.

20.4. No limitation in these Terms and Conditions shall be interpreted as transferring Dr. Martens Indonesia’s ordinary business or product liability to the consumer.

XXI - COMPLAINTS AND DISPUTE RESOLUTION

21.1. Dr. Martens Indonesia encourages you to first contact Customer Service so that the issue can be resolved promptly.

21.2. Dr. Martens Indonesia will:

  • Acknowledge receipt of a complaint within no more than three working days;
  • Accept and commence negotiations within the statutory period, currently no more than seven working days after receiving a valid request;
  • Request additional information only where reasonable and necessary; and
  • Provide written reasons if it refuses to negotiate or rejects a request.

21.3. If the matter cannot be resolved through negotiation, you may refer it to Indonesia Ministry of Trade’s Directorate General of Consumer Protection and Trade Order at +62 853 1111 1010.

21.4. Nothing in these Terms and Conditions restricts a consumer’s right to complain, report a violation, commence legal proceedings, seek compensation or use any other available dispute resolution mechanism.

XXII - FORCE MAJEURE

22.1. A “Force Majeure Event” means an objective event that could not reasonably have been foreseen and could not be remedied despite the affected party taking all necessary and reasonable measures.

22.2. A Force Majeure Event may include a serious natural disaster, war, riot, terrorism, epidemic, prohibition by a competent authority, severe transportation or telecommunications disruption, or a similar event satisfying all requirements of Section 22.1.

22.3. The affected party must:

  • Notify the other party within a reasonable period;
  • Provide information on the impact;
  • Take reasonable measures to mitigate loss; and
  • Continue performing unaffected obligations.

22.4. If a Force Majeure Event prevents Dr. Martens Indonesia from delivering within a reasonable period, you may choose to continue waiting, agree an alternative arrangement or cancel the unperformed part of the order and receive a refund.

XXIII - SUSPENSION AND TERMINATION OF WEBSITE ACCESS

23.1. Dr. Martens Indonesia may restrict or terminate your access where you:

  • Use the website unlawfully;
  • Access or damage the system without authorization;
  • Engage in fraud or impersonation;
  • Infringe intellectual property rights; or
  • Materially breach these Terms and Conditions.

23.2. Account restriction does not remove your rights in relation to accepted orders, refunds, warranties, complaints or other rights arising before the restriction, unless otherwise provided by law.

XXIV - ASSIGNMENT

24.1. You may not assign rights or obligations under an order where the assignment changes the recipient, payment risk or verification requirements without Dr. Martens Indonesia’s reasonable consent.

24.2. Dr. Martens Indonesia may transfer the Website operations or contracts in connection with a merger, consolidation, restructuring or transfer of business, provided that:

  • Your rights are not reduced;
  • The transferee assumes the relevant obligations;
  • Notice is given where required by law; and
  • Your consent is obtained where the transfer of obligations requires such consent by law.

XXV - AMENDMENTS

25.1. Dr. Martens Indonesia may update these Terms and Conditions to reflect changes in law, Website functionality, payment methods, operations or business policies.

25.2. The revised version will state its effective date and be clearly published on the Website. For material changes significantly affecting account holders, Dr. Martens Indonesia will provide reasonable prior notice unless an immediate change is required for legal compliance or security reasons.

25.3. Changes apply only to Website use and orders arising on or after the effective date. An accepted order remains governed by the version in effect when the contract was formed unless:

  • The change is required by law;
  • The change is more favourable to you; or
  • You expressly agree to the change.

25.4. Continued access to the Website after the effective date does not constitute acceptance of an amendment to a sale contract already formed.

XXVI - NO WAIVER, SEVERABILITY AND SURVIVAL

26.1. A party’s failure or delay in exercising a right does not constitute a waiver of that right.

26.2. If a provision is held invalid, unlawful or unenforceable, it will be modified to the minimum extent necessary or severed from these Terms and Conditions. The remaining provisions will continue in effect, provided that this does not remove any mandatory consumer right.

26.3. Provisions concerning intellectual property, personal data, payment, refunds, liability, complaints and dispute resolution survive termination of an account or Website access to the extent necessary.

XXVII - GOVERNING LAW AND JURISDICTION

27.1. These Terms and Conditions and transactions between you and Dr. Martens Indonesia are governed by the laws of the Republic of Indonesia.

27.2. A dispute will be resolved by the competent authority or court under Indonesian law. Nothing in these Terms and Conditions requires a consumer to waive any choice of forum made available by law.
